Southwestern Bell Media, Inc. (Bell) sued Elliot L. Trepper, doing business as Dallas Building Systems, for breach of contract. Trepper attempted to avoid liability on the contract by claiming that he was the agent for Innovative Metal Building Concepts, Inc., doing business as Dallas Building Systems. Bell now appeals an adverse judgment and raises six points of error. We sustain Bells first two points of error.
